A few weeks ago, a Cape Coral driver was arrested after taking deputies in a two-county chase that ended at a 7-Eleven, where the man threw money at witnesses in an attempt to silence them. If I represented this client, I would determine the initial interaction between my client and the police.

It may be important to determine what motions are relevant to our defense. In addition, I would have him undergo a complete psychiatric/ psychological examination. The allegations are serious and there are numerous potential eye witnesses who could testify at trial.

  • Does my client have a drug or alcohol abuse history?
  • Was he in a blackout and possibly lacked criminal intent?
  • Does he have a prior criminal history?

The long police chase and the throwing of money and entering another car after the crash may support (although unlikely) an Insanity Defense in FL.
