The Quarterback for the University of Florida Gators was arrested Wednesday for possession of Child pornography in Gainesville Florida, setting a new standard for the term “Florida Man.” According to the police report provided by Gainesville police, Jalen Kitna, a redshirt freshman, was found in possession of the alleged material in two places, both inside his home and on a phone app. Upon his arrest the Athletic association immediately suspended Kitna indefinitely.

The transmission, distribution, possession, and manufacture of child pornography is a third-degree felony under Florida Statutes 847.0135, 847.0138 and 827.071. Therefore, Kitna could be facing a prison sentence of up to five years per count and these sentences could be run consecutively. The most common and strongest defense to the crimes Kitna is facing is lack of knowledge, in other words the defense that he was not aware he was in possession of the child pornography. For instance, if malware or by some other means the alleged material made its way to his devices without him knowing. However, this defense will proof especially difficult for Kitna, considering the material was found both inside his home AND on his phone.
